The non-disclosure petition alleges that in response to the RTI filed by the petitioner, the state Election Commission stated that it did not have a VVPAT machine. In the absence of a VVPAT machine, the State Election Commission announces the issue of holding local body elections on ballot paper.


The petitioner also made a written representation to the State Election Commission on 1 January 2021 on the issue. To date, however, no response has been claimed. The petitioner has sought directions from the State Election Commission to submit a status report before the Gujarat High Court on the issue. The petitioner has also cited the judgment of the Central Election Commission in the PIL case against Subramaniam Swamy.
